Direct infringement： 35 U.S.C. 271 Infringement of patent. (a) Except as otherwise provided in this title, whoever without authority makes, uses, offers to sell, or sells any patented invention, within the United States or imports into the United States any patented invention during the term of the patent therefor, infringes the patent. 【除本法另有規定外，於專利權存續期間，未經許可於美國境內 製造、使用、要約銷售，或銷售已獲准專利之發明產品，或將該專利產品由外國輸入至美 國境內，即屬侵害專利權】 即當被控侵權之產品經由專利侵權鑑定過程確定該被控侵權產品係符合「全要件」或「均 等論」而使侵權成立時，此即為一般所謂的「直接侵權（direct infringement）」。 II. Induced infringement 35 U.S.C. 271 (b) Whoever actively induces infringement of a patent shall be liable as an infringer.【積極教唆他人侵害專利權者，應負侵權責任】 此種Induced infringement之侵權被告其本身並未"直接"侵害到專利權範圍，但是其誘使 （induce）或促使他人（通成可能是消費者）造成直接侵權。例如，假設專利權係由要件 A、B、C所組成的一個裝置，今有一侵權者販賣零件A。販售者在零件A的包裝說明中指導 使用者如何將零件A與B、C組合使用，亦即"誘導"（induce）使用者造成"直接侵權"；則 販賣零件A者依專利法271(b)就可能造成Induced infringement。 III. Contributory infringement 35 U.S.C. 271(c) Whoever offers to sell or sells within the United States or imports into the United States a component of a patented machine, manufacture, combination or composition, or a material or apparatus for use in practicing a patented process, constituting a material part of the invention, knowing the same to be especially made or especially adapted for use in an infringement of such patent, and not a staple article or commodity of commerce suitable for substantial noninfringing use, shall be liable as a contributory infringer.【要約銷售或銷售，或由外國進口，屬方法專利重要部分之機 器構件、製品組合物或化合物，或實施方法專利權所使用之材料或裝置，且明知該特別製 作或特別引用乃係作為侵犯該項專利權，當上述情形並非作為主要或屬不具實體侵害作用 之商業上物品時，應負幫助侵權者之責任】 例如，假設專利權係由要件A、B、C所組成的一個裝置，今有一製造者製造及販賣零件A 。如果零件A是該專利之裝置的一個重要（material）元件，且零件A並沒有其它獨立用途 （i.e.,零件A係專屬與B、C組合使用的），則該製造或販賣零件A者依專利法271(c)就可 能造成contributory infringement。 此種Contributory infringement之侵權被告其本身也是沒有"直接"侵害到專利權範圍， 但由於其製造、販賣專利產品之部分零件，且該零件是專利產品的重要組成部分，且消費 者購得該零件後，當其使用時會造成「直接侵權」; 此時，該零件之製造者即可能構成了 「contributory infringement」。 上述之「induced infringement」 及 「contributory infringement」均屬於間接侵權 （indirect infringement）之態樣。 --
