Obviously, however, the failure to provide explicit antecedent basis for terms does not always render a claim indefinite. If the scope of a claim would be reasonably ascertainable by those skilled in the art, then the claim is not indefinite. Energizer Holdings Inc. v. Int’l Trade Comm’n, 435 F.3d 1366, 77 USPQ2d 1625 (Fed. Cir. 2006) (holding that “anode gel” provided by implication the antecedent basis for “zinc anode”); Ex parte Porter, 25 USPQ2d 1144, 1145 (Bd. Pat. App. & Inter. 1992) (“controlled stream of fluid ” provided reasonable antecedent basis for “the controlled fluid”). Inherent components of elements recited have antecedent basis in the recitation of the components themselves. For example, the limitation “the outer surface of said sphere” would not require an antecedent recitation that the sphere has an outer surface. See Bose Corp. v. Cir 2001) (holding that recitation of “an ellipse” provided antecedent basis for “an ellipse having a major diameter” because “[t]here can be no dispute that mathematically an inherent characteristic of an ellipse is a major diameter”). 簡單說就是名詞不一樣但技藝習知者可確知是指同一元件的情況下 並不一定會造成缺乏前置基礎的情況 Ex parte Porter這個案子的claim是先寫"controlled stream of fluid" 後面用"the controlled fluid"來指同一流體 另外,元件本身就固有的組件/成分也不是一定需要寫出才有前置基礎 像是先claim一個球體"sphere", 後面可以直接說該球體的該外表面 "the outer surface of said sphere" 另外在Bose Corp. v. JBL, Inc.這個案子中, 橢圓"ellipse"提供具有長軸的橢圓"ellipse having a major diameter"前置基礎 因為橢圓在數學上的固有特性就是有長軸 mpep在Lack of Antecedent Basis這段裡面 還有提到另一種因為"the" "said"導致claim不明確的情況 就是claim中有兩個類似的元件用同樣的名詞 也就是claim中包含: "元件1", "元件2", "前述的元件" 雖然不算缺乏前置基礎 但是會導致"前述的元件"不知道指的是哪一個提到的元件 不過就前文提到的claim兩種情況來看 the metal oxide of the layer of the metal oxide a metal oxide of the layer of the metal oxide 應該都可以理解是氧化金屬層的氧化金屬 不會造成不明確的解讀 我個人覺得比較需要注意的是關於claim scope的解讀 這兩種寫法應該是不同的 獨立項是comprising: a layer of a metal oxide 在申請文件或答辯中沒有特別定義的情況下 在開放式的comprisng後面的 "a" 通常都是指 "one or more" 也就是在解讀獨立項的時候 若申請文件中沒有特別強調單一成分 則意思會是"包含最少一氧化金屬的最少一塗層" 這種情況下 the metal oxide of the layer of the metal oxide is WO3 指的是塗層的該最少一氧化金屬就是WO3 a metal oxide of the layer of the metal oxide is WO3 指的則會是"該最少一氧化金屬塗層中的最少一氧化金屬是WO3" 換句話說就是一個解讀上會只有一種成分 另一個可能有多種成分或單一成分 以上這是我覺得這兩種寫法的主要區別 -- --
