DoD 就確立州長不得拒絕國民兵在國外調動 12/12 09:30 : → leptoneta: 現在州長同意只是行政流程儀式而已 12/12 09:31 首先國民兵是不是要有或者應該說美國是不適應該有常備部隊 是從開國元勳就開吵了 吵到後面就是州有州的中央有中央的，即便到今天所謂的國民兵出動並不是美國總統下令 而是美國總統商請州長，得到州長同意出動國民兵 附帶一提 認真說美國其實有三個不同單位，一個是直屬的美軍，一個是國民兵，還有一個很少見的 州警衛隊(州長限定) 那麼美國總統在甚麼狀況下可以繞過州長呢？叛亂，所以相關報導你會看到很多記者都 問川普是不是用叛亂來調動 前面有人說海外調動是指蒙哥馬利法案，這個可以被繞過去的原因是，當時兩個州州長 反對把國民兵部屬到中美洲，最高法院裁判是認為這是可以的因為理由是訓練 也就是美國聯邦雖然把國民兵送到海外但因為是訓練，所以不得拒絕它們接受訓練 沒人規定不能把美軍送到格稜蘭島接受極地空降訓練不是嗎 但有但書如果州長認為他有緊急需求就可以拒絕，緊急需求是甚麼沒有規定 川普用的是 美國法典10第12406 Whenever— (1)the United States, or any of the Commonwealths or possessions, is invaded or is in danger of invasion by a foreign nation; (2)there is a rebellion or danger of a rebellion against the authority of the Government of the United States; or (3)the President is unable with the regular forces to execute the laws of the United States; the President may call into Federal service members and units of the National Guard of any State in such numbers as he considers necessary to repel the invasion, suppress the rebellion, or execute those laws. Orders for these purposes shall be issued through the governors of the States or, in the case of the District of Columbia, through the commanding general of the National Guard of the District of Columbia. 每當- （1）美國或其任何聯邦或屬地遭到外國入侵或面臨外國入侵的危險； （2）存在反抗美國政府權威的叛亂或叛亂危險；或者 （3）總統無法依賴正規軍來執行美國法律； 總統可根據需要，徵召聯邦軍人和任何州的國民警衛隊成員，以擊退入侵、鎮壓叛亂或執 行相關法律。為此目的的命令應透過各州州長發布；在哥倫比亞特區的情況下，則應透過 哥倫比亞特區國民警衛隊司令發布。 --
