最近一个印度朋友遇到的问题想请教各位大大，我朋友他是 EB2， 要排很多年，最近经济的影响，公司也不知道能撑多久，他最近 PERM 下来，本来想丢I-140 （因为他有听闻如果他去其它公司， PD 可以跟着他)，後来公司跟他说不行，只有 I-485 pending 180天的人的人可以。我跟他说律师应该是指 AC21，律师也许误 会他的意思、或着是不想跟他说。 台湾人大部分应该都不会有这方面的问题，我在版上没有找到类似的问题， 我找到8 CFR 204.5 ，上面有一段: 「(e) Retention of section 203(b) (1), (2), or (3) priority date. A petition approved on behalf of an alien under sections 203(b) (1), (2), or (3) of the Act accords the alien the priority date of the approved petition for any subsequently filed petition for any classification under sections 203(b) (1), (2), or (3) of the Act for which the alien may qualify. In the event that the alien is the beneficiary of multiple petitions under sections 203(b) (1), (2), or (3) of the Act, the alien shall be entitled to the earliest priority date. A petition revoked under sections 204(e) or 205 of the Act will not confer a priority date, nor will any priority date be established as a result of a denied petition. A priority date is not transferable to another alien. 」 上面看起来似乎是说，只要之前的 I-140 已经核准(并且没有取消)，之後 的I-140就可以使用之前的Priority Date。上述也没有提到需要类似的工作， 只讲要符合 203(b)(1),(2),or(3)。请问这样解释正确吗？ 如果他离开现在的公司，如果公司不撤销他的 I-140，是不是就没问题了？ 公司要是日後倒掉，之前的I-140还有效吗？ 请大大指点，谢谢！ --
