写得有点迟，中间换了工作还有包含帮老婆境外申请的许多状况， 整个时程和内容有点长请多包涵，希望复杂的经验能对要申请的人有帮助。 我会把心得写在最後。 Category: EB2NIW filed concurrent Center: NSC (Maryland) Background: US Bioengineering PhD with 5 papers (2 first author). Status: F1(OPT) - Postdoc fellow in Federal government Reference Letter: 4 (3 independent, 1 dependent-who is the first author of one of my paper) Retained VC: Sep 2015 Begin to prepare documents and reference: April 2016 Sent out final documents to Attorney: July 2, 2016 (OPT expired on 8.23.2016) Attorney sent package to USCIS: July 6, 2016 I-140 USCIS received date: July 8, 2016 LIN1690825xxx Received notice: July 15, 2016 I485 USCIS received date: July 8, notice: July 15, 2016 I485 Finger print fee received: July 14, 2016 LIN1690826xxx Biometrics notice received: Aug 4, 2016 (scheduled Aug 19) Contact Congressman Hoyer office for EAD: Aug 9, 2016 (was told the immigration staff came back on Aug 15) I765 Approved: Aug 19, 2016 (got the reply from Congressman office on Aug 22 said the EAD/AP card was approved and mailed) Received EAD/AP combo card: Aug 26, 2016 Dec 27, 2016, Matter of Dhanasar replaced the old NYSDOT standard, and made NIW seriously delay. EAD/AP renewal received: May 5, 2017 Service request. Expect a reply by July 1, 2017 Service request again on 90th day. Aug 7, 2017 Expect a reply by September 6, 2017 New EAD/AP card was mailed: Sep 6, 2017 Online status of I-140 changed to approval on July 21, 2017 but retrogression from Sep 2017 I485 Request for Evidence: Sep 8, 2017 1. I-693 (More than 1 year) 2. Continue for NIW occupation Discussed with attorney and sent out RFE package: Oct 2, 2017 Package received notice: Oct 5, 2017 Oct 24, 2017 received Biometrics notice, schedule on Nov 17, 2017. Oct 30, 2017 walked-in another closer USCIS ASC and done with Biometrics. Green card ordered: Nov 3, 2017 Green card mailed: Nov 8, 2017 Consular Process (CP) For my wife, I sent her application with Consular process instead of I-485 since she was born in China and suffered of J1-212e 2yrs requirement while I applied green. Therefore, she must stay at China before fulfilling the requirement (she still came to visit me several times). File I-824 for my wife: Jan 25, 2017. Notice date: Jan 30, 2017. LIN1790351xxx I-824 approved: February 12, 2018 NVC received case from NSC: Feb 26, 2018, GUZ2018554xxx but indicated wrong Country of Chargeability (China), and it required VISA number. Therefore, it's been held. (I've stated she can utilize my cross-chargeability of Taiwan instead of China in her cover letter, but it's obvious they didn't read!) Contact Congressman twice on March 7, and March 20, 2018, NVC still insisted they are correct in Foreign State Chargeability for my wife: CHINA. Kept contacting Congressman. Informed by NVC Rep in phone said the status was corrected from held to Current in April 2018. Contacted Congressman in June 2018, to push the frozen NVC case. NVC Welcome letter with Invoice ID number: July 3, 2018. Chose agent on the same day. Received application letter to pay fee: July 19, 2018. Prepared and sent out all required document on the same day. Received all the all the requested documentation: Aug 24, 2018 Sep 2018, Retrogression. Sep 19, 2018, Scheduled interview on Oct 31, 2018 at Guangzhou consulate. Oct 31, 2018, Pass the interview. Nov 2, 2018, VISA issued. Nov 6, 2018, Passport and Package received. 申请的时机很重要，我申请完不到半年三普上任，然後Dhanasar胜诉，所以我的NIW140 从之前的半年多卡到了一年多，造成後来通过後马上485被retrogression卡到，加上 EAD迟来而放无薪假，体检得重作指纹也要重押，然後还得重新证明我仍继续在相关领域 的贡献(啊不就还好我没被辞退)。重押指纹的ASC一开始也是安排很久以後，而且在开车要 一小时多的地方(！！) 还好看网路分享我提前跑到附近的ASC去，都没人排队也让我押了 ，所以绿卡也早了些通过了。 虽然2015就跟VC签约了，不过一直拖到2016的四月才突然发觉得开始申请，因为八月 我的OPT就到期了！！ 超抖的情况下才突然的紧急开始准备资料和联系律师，若能早点弄 其实就不会遇到那麽多事了。 VC当初把我列的一堆大头和指导教授们通通删掉，只选了 一个我期刊的第一作者和另三名在学术圈、药厂上班的朋友的朋友-分别是助理教授和 员工(标准的independent，出外真的要靠朋友！)，她还跟我强调四封就够了不用多， 虽然我那时候心里觉得他们是懒得draft，不过事後证明四个不有名的学者其实也够了。 中间为了省时间趁老婆还在她家作J1的两年牢的时候丢了I-824走境外程序(Feb 2017丢, 她要到Oct 2017才出关)，没想到2018年初是通过了，却因为审的人没留意把她分配到 China，结果来来回回又多浪费了半年在申诉。等到她交完钱，又遇到一次retrogression (泪，一人一次挺公平？！)。 唯一庆幸的是我当初开心递I-824的时候把她面试的使馆写 成上海了，後来才发现全中国只有广州使馆可以面试移民！幸好NVC那边很聪明的把资料送 到广州，否则又要浪费不知道多久时间在改正！！(还是有聪明的人，或是根本没在看) 如果能重新选的话我应该会等她2017十月一出关以後来美国再重新改成I-485申请，就能 直接拿EAD上班也不需要担心被弄错名额。当初有这麽想但是觉得理论上很快就通过了应该 不需要再浪费一次钱，事後证明能花钱解决的都不该省，这些官员尤其是USCIS的那群都不 该信任。无论是SR, 打电话, 跟congressman联络及infopass，都同样遇到很多很虾的答案 ，所以能够帮他们减少他们工作(出错)的方法都是好方法。 申请的中间她用以前办的十年观光签来美国玩，直接跟海关说要来找老公玩，听说还聊 得很开心(?) 所以也不像网路上写的不能入境，但也可能看人品？！ 不过总的来说我感觉自身的人品不是很好啊~~~ 能通过要感谢许许多多版友及前人的经验 分享，还有给力的律师、议员和认识及不认识的推荐人们~~~ 最後祝大家都顺利申请快速通过!!! 猪年好运~~~ --
