请问一下 如果原本485/140是用EB2 file且已经Pending 180天 但在同公司降级到EB3而file新的140 那可以用这新EB3 140跳槽到其他公司吗 还是要新的EB3 140 "approve"後满180天? 我原本以为AC21是只要485 pending 180天及140 approve就可以跳. AC21 180天条款是跟 着485 但根据below说如换employment based category後180天clock要reset, 不知是否正确? 有高手知道吗 感谢 If an employment-based applicant requests to transfer the adjustment application to a different employment-based category based on a new Form I-140, the applicant may not utilize the portability provisions, if applicable, until 180 days or more after making the transfer request.
