So how are the Wizards going to deal with Gilbert Arenas from here on out? We
mean, other than closing their eyes, hoping it's all been a bad dream and
praying that the whole thing goes away.
The Wiz have some decisions to make, none of them easy.
"I have not given any advice to them," said NBA commissioner David Stern,
after sending Arenas home for the season. "They have an issue to deal with
and I have to represent all 30 teams. I am sure there are lawyers who will
exchange discussions and views with them."
In other words, have fun getting out of your own mess, Washington.
From all accounts, the Wiz will try to void Arenas' remaining four seasons,
worth around $80 million. But according to several team executives, it will
be anything but be easy, even if they contend that Arenas violated the morals
clause of his contract and/or the part of his contract pertaining to
committing a felony. He is awaiting sentencing March 26 on a felony gun
conviction.
"It's going to be extremely difficult," said one Eastern Conference team
president. "In all player contracts, you have these clauses that can void it.
But there are also a lot of protections in the contracts for the players. The
contracts almost protect the employee better than the team."
The language in the morals clause is vague and has never been successfully
used to void a deal. The most celebrated instance of a team that tried to
void a contract came after Latrell Sprewell choked Golden State coach P.J.
Carlesimo at practice in 1997. The Warriors tried to invoke the morals clause
in voiding the final three years of Sprewell's deal, worth around $24
million. But the arbitrator, John Feerick, then dean of Fordham's School of
Law, reinstated the contract.
Sprewell's attack is viewed as more serious than what Arenas did when he and
Javaris Crittenton had their showdown with firearms in the Wizards' locker
room.
"As bad as what Arenas did, he didn't shoot a gun and it wasn't loaded," said
an Eastern Conference GM. "He acted stupidly and then he made a mockery of
the whole thing when he pretended to be shooting his teammates, but it's not
as if he raped somebody. What he did was wrong, but it probably isn't serious
enough to void his deal."
That's bad news for Washington president Ernie Grunfeld. At this point,
Arenas is almost impossible to trade, given the length and size of his
contract and the fact that he's been playing on a knee that has undergone
surgery three times. To begin with, he was thought to be vastly overpaid.
Now, this latest incident makes him almost radioactive.
