标题[闲聊] Claim的构思 (Landis)

在构思claim的数个步骤中,
首先要考量claim撰写目的:
1. 涵盖发明内容(Covering the invention):
1-1: 书中提到要尽可能地将申请专利范围写大,
并且涵盖发明概念(invention concept)。
ps: 应该是要尽可能写大并涵盖发明技术特徵。
1-2: 书中提到要申请专利范围要能包括说明书中的实施例。
这是确保万一较大专利范围遭判定无效(are held invalid)後,
至少还有一个能对应实施例技术特徵的较小专利范围(valid)以保护发明技术。
2. 申请专利范围应尽量写大(Claim coverage should be as broad as possible):
所谓的尽量写大是指除了包括特定较佳实施例外,
并且涵盖所有可预期发生或非预料中的均等物。
3. 涵盖对应发明之产物或方法(Cover competing Products or Methods):
3-1: 涵盖 相对应/相同(identical)之产物,
特别是 相对应/相同(identical)之较佳实施例
3-2: 涵盖近似於已主张之发明(clamed invention)的产物或方法:
3-2.1 涵盖相似产物或方法不同於已揭露於说明书及图示的部分,
但却也能实施相同之发明概念
(ps:涵盖可实施发明之技术特徵但却未揭於说明书及图示中)
3-2.2 达成相同结果相对应(competitive)之产物或方法
ps:这一段说明文字较长,依我的解读.
主要的观念就是claim要能包括专利发明技术特争均等之物或方法。
在书中有提到"equivalent"的定义不等同於 DOE的部分,
这部分可综合参考mpep2144,2183,2184,2186以及 112 paragraph 6。
4. 回避先前技术(Avoid Prior Art):
申请专利范围要避免读取(read on)先前技术,
范围要能包含发明且尽量写大,并与先前技术有所区隔
5. 无非必要之限制 (No unnecessary limits)
这边提到在claim中回避前案就是回避非必要限制,
(Coupled with the avoidance of prior art is the avoidance of unnecessary
limitations in the claims)
ps:论述中提到35USC 112, 我想应该是对应112 paragraph 4的内容而言
单纯心得,因此文字翻译没很计较,谨供参考

Coupled with the avoidance of the prior art is the avoidance of
unnecessary limitations in the claims, those not dictated by prior art or
by proper form under the rules and practices of claim drafting which are in
part set out in the Manual of Patent Examining Procedures and are required
by 35U.S.C. section 112 of the Patent Act.
