标题[问题] U.S.C.102 之适用

[本文有点长 其与U.S.C.102(d)之组成要件相关]
今天某教授打电话给俺问一个案件的案情 大意如下：
案件暂称 甲案，甲案之发明(A)於95年1月1日完成，未公开。
延至100年1月1日於中华民国提出申请 并於101年6月公开(P)
并於101年8月收到第一次审查意见通知书 美国案尚未申请
教授问： 假设该P为唯一记载(A)之文件 教授是否仍得就该(A)於美国取得专利?
我回答: 是。USC 102(b) 未就早期公开予以排除 故此应适用1年优惠期之条款
後来 总觉得哪怪怪的 翻一下法条 才惊觉自己的回答很有问题
U.S.C. 102(d) 上半段 ●
"the invention was first patented or caused to be patented, or
●
U.S.C. 102(d) 下半段
(the invention) was the subject of an inventor’s certificate...
assigns in a foreign country prior to -the date of the application
for patent in this country- on an application for patent or inventor's
certificate filed more than twelve months before the filing of the
application in the United States
●
发明人在美国以外的国家取得专利或发明人在美国申请日一年前在他国申请专利
即其受U.S.C.102(d)阻却而丧失新颖性
在绝望之际 看了一下其MPEP之说明 问题就来了

GENERAL REQUIREMENTS OF 35 U.S.C. 102(d)
●所有
35 U.S.C. 102(d) establishes four conditions which, if all are present,
establish a bar against the granting of a patent in this country:
(C) The foreign patent or inventor's certificate must be actually granted
before the U.S. filing date. It need not be published.

就目前来看 唯一能有转机的是『inventor's certificate』一词的定义
又 MPEP全文检索没找到其定义.. 有请版上先进不吝指教 谢谢 小的谢过
