男玩3P致死 医师没警告判赔9千万

美国一名男子马汀尼(William Martinez)在2009年与一男一女玩3P游戏，引发
心脏病致猝死，马汀尼死时才31岁。昨日当地法院宣判，马汀尼的死与他的主
治医师港嘎沙尼(Dr Sreenivasalu Gangasani)未尽治疗责任有关系，引此判
决港嘎沙尼必须赔偿马汀尼家属300万美元(约新台币9千万元)。
法官认为，马汀尼曾向港嘎沙尼寻求治疗胸痛的问题，港嘎沙尼也为马汀尼
安排疗程，却没有告知马汀尼禁止做「激烈运动」，导致马汀尼在玩3P时致死，
因此港嘎沙尼必须负担未告知的医疗责任，判赔300万美金。港嘎沙尼
的代表律师表示仍会再上诉。

美国的判决越来越夸张,而台湾又常跟着美国,
偏偏岛上的医疗是不能把法律风险提列成本转嫁给病人的,
以後连看门诊都可能吃上一堆奇怪的医疗纠纷大概也不会太意外
